A theocracy is a government where a religious institution has direct control over all levels of government. Implying that because people vote on religious grounds, the United States is a theocracy is not an outrageous statement. This is evidenced by the fact that abortion, alcohol, divorce, premarital sex, and homosexuality are all legal. If the Bible was the the Constitution, this would not be the case.





As for the second part of your question, it would depend on the means by which the Constitution was modified. Having moral laws based on religion in and of itself does not justify the label of a theocracy.
No not necessarily. There are many atheist who believe in the same moral principals the Bible has to offer.Historically the Bible is the first written moral law published.Our forefathers thought that it would be relevant for all generations to abide by some moral law and the Bible was most readily available.If we didn't have moral law things would be really bad. If someone killed my wife and the law didn't do anything because of separation of ';church and state'; I would be seriously pissed. I believe people don't like boundaries until their boundaries have been crossed.
